1. General Information
Yoake Gallery (hereinafter “we”, “our” or “the Seller”) is a commercial business registered under Swiss law that offers personalized products through print on demand service.
2. Scope of Application
These general terms and conditions govern the sale of all products offered by Yoake Gallery on the website. The purchase of any product implies the full and unconditional acceptance of these terms and conditions by the buyer (hereinafter “Customer”).
3. Formation of Contract
The sales contract is considered concluded when the Customer clicks on the “Buy” button or equivalent. With this action, the Customer accepts the product, the price and the conditions of sale as presented on the website.
4. Customized Products
Nature of products: All products offered by Yoake Gallery are made according to the print on demand model and are customized based on the specific requests of the Customer.
Production process: Production begins only after receiving the order and completing payment. Once the order enters the production phase, it will no longer be possible to make changes.
5. Prices and Payment Methods
The prices indicated on the website are in euros and do not include VAT, which is calculated at the time of payment according to each country’s rate. Payment must be made in full at the time of ordering through the payment methods available on the website.
6. Delivery
Yoake Gallery commits to process orders in the shortest possible time. Delivery times are indicative and may vary based on the production times of customized products. The Customer will receive an email notification with the tracking number when the order is shipped.
7. Return and Refund Policy
No right of withdrawal: In accordance with Swiss law and due to the customized nature of print on demand products, there is no right of withdrawal or return once the order has been confirmed and entered into production.
Exceptions: Requests for refund or replacement will be accepted exclusively in the following cases:
– Product received significantly different from what was ordered
– Product with printing or production defects
– Product damaged during transport
Claim procedure: In case of defective product, the Customer must contact Customer Service within 7 days of receipt, attaching photographs documenting the defect.
8. Warranty
In accordance with the Swiss Code of Obligations, we guarantee our products against conformity defects and hidden defects for a period of two years from delivery.
9. Intellectual Property
Yoake Gallery operates through specific license agreements with the artists who create the works reproduced on our products. By virtue of these agreements, we guarantee that all products sold on our site are original and marketed under official license.
Ownership of rights: Intellectual property rights on all works, images, designs and artistic content remain the exclusive property of the original artists or their respective owners.
Sales license: Yoake Gallery holds the necessary license rights for the reproduction, marketing and distribution of the works on the items for sale through the print on demand service.
Limitations of use: The purchase of a product does not in any way imply the transfer of intellectual property rights to the buyer. The Customer acquires only the ownership of the physical object purchased and is not authorized to:
– Reproduce the work
– Create derivative works
– Use the image for commercial purposes
– Assign, sublicense or transfer any rights to the work
Authenticity: Yoake Gallery guarantees the authenticity and legitimacy of all products sold in accordance with the license agreements stipulated with the artists.
